Rates for A.C.T. Video Productions, Inc. (hereinafter referred to as ACTVP) are based on regular working hours of 8:30 am to 5:00 pm, Monday through Friday. In cases which a production schedule does not fall during regular working hours, after hours are available. Editing rates are charged in ½ hour increments with a one hour minimum charge. Videotaping rates are based on 10 hour days, portal to portal. Half day productions that run over 5 hours will be billed for the full day rate. Items not provided by the Client including tape stock, meals, parking, expenses, travel, mileage (outside of a 35 mile range from our studio), props and extra equipment will be billed separately.

Proper notice of cancellation is required 24 hours in advance. Notification given later than 24 hours is subject to a cancellation fee, to be determined by the type of project.

Client warrants that all materials supplied to ACTVP by the client do not in any way defame, violate or infringe on copyright or any other rights of any other person, firm or corporation. Client is responsible for any copyright clearances, clearances for talent, locations and production materials that are supplied to ACTVP by the Client for use in the creation of the project, including, but not limited to stock footage, music and photographs. Client agrees to indemnify and hold ACTVP, its officers, directors, agents and employees harmless from any liability or damages for infringement of copyright arising from the use of duplication of material supplied by the customer and agrees to pay all legal fees.

Normal payment terms are divided into three payments: 1/3 deposit reserves the date of service, 1/3 payment due when production begins with the remaining balance due upon project completion. Delinquent accounts are subject to a 1.5% monthly service fee. Expediting charges may apply.

Our prices and services are based upon delivery of materials at our place of business. For delivery elsewhere, a handling fee plus applicable shipping charges will apply. Tax will be added in accordance with Washington State law.

Client’s tapes or other materials received, processed and stored by ACTVP are solely at the Client’s risk. For loss or damage resulting from defects in ACTVP supplied material or equipment, or negligence of ACTVP’s personnel, ACTVP will perform the services again without penalty to the Client. All damages, consequential or otherwise, (including, without limitation, lost profits) are expressly assumed by the Client. ACTVP shall not be held liable or responsible for loss, damage, destruction of tapes, storage media, data storage, or any property, for delay, for acts or omissions by our personnel, or for equipment failure for any reason. Client is responsible for insurance of masters, duplication masters or camera originals, equipment or other materials left with ACTVP. Materials archived with ACTVP may be destroyed after 3 years.
